Excess Hours of Work Agreement

I, the undersigned, understand that based on the business needs of Universal Staffing Inc., I may be scheduled or requested to work in excess of 8 hours per day and up to 60 hours per work week while on assignment.
As such, by my signature below, I agree with my employer, Universal Staffing Inc., to work in excess of 8 hours per day and up to 60 hours per work week if and when scheduled or as I am requested to do so. For the purposes of this agreement, a "work week" shall mean the period of seven consecutive days selected by Universal Staffing Inc. for the purposes of scheduling work. However, I expressly understand that nothing in this agreement guarantees me up to 60 hours of work per work week. I specifically acknowledge and agree that my hours of work will be those scheduled or requested by the company from time to time.
I have read and agree to the terms set out above and acknowledge that this agreement is entered into in accordance with: The Ontario Employment Standards Act, 2000 as amended.
I acknowledge retaining a copy of this agreement and receiving a copy of the Ministry of Labour's fact sheet entitled Information for Employees About Hours of Work and Overtime Pay. I understand, acknowledge and agree that any notice or questions concerning this agreement shall be forwarded in writing to:

Substance Abuse in the Workplace

Universal Staffing Inc. has vital interests in ensuring a safe, healthy and efficient working environment for our employees, their co-workers and the customers we serve. Using or possessing alcohol or other intoxicating drugs in the workplace presents a danger to everyone.

All jobs are safety sensitive, therefore, the Substance Abuse Policy applies to all our Employees and for these reasons, we have established, as a condition of employment and continued employment with the company, the following intoxicants in the workplace policy:

Controlled substances, illegal substances of beverages of an intoxicating nature are prohibited in all work placement sites due to safety regulations
All Universal Staffing Inc. employees are prohibited from reporting to work or working while under the influence of alcohol and/or other drugs that adversely affect the employee's ability to safely perform his or her job duties.
Universal Staffing Inc. does not engage in random and/or pre-accident drug testing of employees upon hire. Employee substance abuse problems will be identified by issues with behaviour and measures of performance only unless work placement has a policy for testing in effect. (Conditions may apply).
Employees are prohibited from reporting for duty or remaining on duty with any alcohol or any other intoxicants in the systems. Employees are further prohibited from consuming alcohol or other intoxicants during working hours, including meal and break periods.

Universal Staffing Inc. understands that there is a difference between substance use and substance abuse, and that use isn't necessarily abuse. Employees are free to make their own lifestyle choices when not in the work place or otherwise on company time. However, such choices must not be allowed to interfere with job performance. if it is determined that an employee is hindered in their ability to perform their job duties due to being under a substance, they will be subject to discipline of varying degrees.

Failure to comply with the foregoing substance abuse policy may result in disciplinary action, up to and including discharge.

A Workplace vehicle is a vehicle used by an employer or employee to conduct any type of work in an enclosed workplace. Similar to no smoking inside an office building, smoking is prohibited in the workplace vehicles, 24 hours a day/7 days a week, before or after work hours and whether there are no passengers. Ashtrays, or equivalent, are NOT to be utilized for smoking purposes.

Non-Driver positions are prohibited from smoking in or on all work place vehicles as well as per company policy. This includes: Loader / Thrower positions.

I have received my personal copy of the Employee Orientation and Guide to Health and Safety in the Workplace. It is my responsibility to read and understand all the policies of employment set forth by Universal Staffing Inc.
I understand that there may be additional policies and procedures given to me by my work assignment management representative that I will be responsible to adhere to and follow accordingly.
I understand that by accepting an assignment from Universal Staffing Inc. that my employer is Universal Staffing Inc. and NOT their client.
I understand that all information acquired during my employment with Universal Staffing Inc. is the property of Universal Staffing Inc.
I understand that if I have any questions, comments or concerns I must bring them up to my local branch office.

Public Holidays Agreement

As an employee in Ontario you are entitled to a total of 9 Public Holidays yearly. The list of Public Holidays in Ontario is as follows:

New Year's Day
Family Day
Good Friday
Victoria Day
Boxing Day

Canada Day
Labour Day
Thanksgiving Day
Christmas Day

Certain job assignments may require you to work on a public holiday. Please note you can refuse to work on a public holiday. Alternatively, you can agree in writing to work on the holiday and you will be paid accordingly at time and half for each hour worked and if they are eligible they will also be paid public holiday pay.

Considerations when determining who is eligible for public holiday pay:

If an employee agrees to work on a public holiday and then does not show up for work they do not qualify for public holiday pay.
If an employee is not present for their entire scheduled shift prior to the public holiday they do not qualify.
If an employee is not present for their entire scheduled shift following the public holiday they do not qualify.
Employees who work in a greenhouse do not qualify for public holiday pay under the ruling of special industries considerations.
Employees who quit and/or are terminated before the public holiday do not qualify for public holiday pay.
Employees who are on vacation during the public holiday and do not return to work afterward do not qualify for the public holiday pay.
Employees hired on by our clients do not qualify for public holiday pay.
Paid time off for any public holiday that falls on a working day, there are conditions to meet in order to qualify for public holiday pay.
